really? I don't think they are, but what rule would you say made that so?

The section that you highlighted is basically saying "Don't create something that will interfere with someone's sensor system".

If they had a giant array of outward facing IR LEDs, I think they'd have a problem, but the way that they're using their infrared sensors seems perfectly legal to me.

Its legal because we do not intentionally try to interfere with other robots systems.
