I can't find anything that says the Delaware department of education has a non discrimination policy towards marital status.

However, even if they did, I think you would have a hard time arguing that they were discriminating based on marital status. Take 3 sets of hypothetical people. One is a male-female couple, unmaried. The second is a male-male couple. The third is a lone female. All 5 people have the same marital status: single.
