Team 3160 Needs Help with Volume!

All right, so if a 28" robot and during the check we say we are using 36x40x24 (I am talking about 40".) Can we go 6 inches out on either side and not go outside max length and be within the rules? And if so, could we keep one side of the robot and have one side extend 12"?
