The only thing that I can see it being against the rule is the placement on visually active backgrounds (photos), strong textures and incompatible shades of color. The header does not include area of the criteria, so I think it falls into a gray area.

If your pertaining to the missing of the text, I don't see any rule about that. Please, tell me if I'm wrong. I'm trying to get the site as accurate as possible.
